Indie licenses for multiple games having gross revenue over 200k

Hi,

I’m sort of an indie dev, just starting my journey. The current licensing description is unclear to me, namely the total revenue by developer and the fee(per title). I was hoping someone could clear things for me, cause I didn’t find the answers or didn’t understand the topics regarding my questions.

  1. If I release a game using FMOD and indie license, then my game exceeds total revenue of 200,000$, I must pay the 2000$ for that game, right?
  2. If I release another game, or multiple games, since I have already exceeded 200,000$ threshold (the revenue part says specifically Total gross revenue / funding per year for the developer), that means I must pay for every other of my games 2000$, even if they don’t make money?
  3. If I release a game with FMOD and it makes very low or almost no gross revenue, then 6 months later I release another game and it makes 200,000$+ in 12 month, I must pay the 2000$ fee for the last game and the first one also?

So I don’t understand why would you tie the gross revenue to the developer, not to a specific title, since the fee is charged for a title. As I understand now, once I pass 200,000$ mark in a 12month period, I’m obligated to pay 2000$ fee for every of my existing titles/games where I used FMOD engine regardless if they make any profit or not.

What I was expecting was I release a game using FMOD, it generates 200,000$ gross revenue, then I pay the fee. Then I release another game, it generates 200,000$ and I pay the fee for it also and so on.

My bad, missed the contact form via email. Answers to my questions were:

  1. No, the license at the time of release is still valid.
  2. If your annual revenue is over $200k, the license fee for each Indie game is $2,000
  3. The fee for each game is determined at the time of release.

Basically, the license(as fees) is locked at the time of release and remain the same. Once $200k gross revenue is reached, new projects with budget below $600k must be licensed with a fee of $2k.
